Terms of Service

These Terms of Service ("Terms") govern your access to and use of Modurian at https://modurian.com (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Cookie Policy.

If you do not agree, do not use the Service.

Modurian is operated by Digital Cloud (digitalcloud.no).

Modurian provides an AI-assisted workspace for planning, generating, previewing, and deploying web projects. Features, models, credit limits, and pricing may change. We may label the Service as beta; features and pricing are subject to change with reasonable notice where practical.

AI outputs may be inaccurate or incomplete. You are responsible for reviewing, testing, and deploying code before production use.

You sign in with Google OAuth. You must provide accurate information and keep your Google account secure. You are responsible for activity under your account.

We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose security or legal risk.

Free accounts receive a one-time credit allowance. Pro is a recurring subscription billed through Stripe at the price shown on our pricing page (currently $40 USD per month unless otherwise stated).

Pro subscription fees (40 USD per month, plus applicable taxes) are non-refundable. If you cancel, you keep access until the end of the current billing period; we do not provide prorated or partial refunds except where required by mandatory consumer protection law.

Credits are consumed when you use AI features (including chat, builds, and Pro tools such as the prompt optimizer). Credits have no cash value, are not transferable, and unused credits do not roll over except as explicitly stated for your plan (Pro monthly credits reset each billing period).

You may cancel Pro renewal through Stripe customer billing or by contacting us; cancellation stops future charges but does not refund amounts already paid.

Chargebacks or payment disputes made in bad faith may result in account suspension.

You will not use the Service to violate law, infringe others' rights, distribute malware, attack systems, generate illegal content, circumvent security, or overload our infrastructure.

We apply automated and manual safeguards (including content policy checks). We may refuse or remove content that violates policy.

We own the Service, branding, and platform software. You retain rights to content you submit and to outputs you create, subject to third-party model providers' terms and applicable law.

You grant us a limited license to host, process, and display your content solely to operate the Service.

The Service integrates Google (sign-in), Stripe (payments), and AI model providers. Your use of those services is also subject to their terms and privacy policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

These Terms are governed by the laws of Norway, without regard to conflict-of-law rules. Courts in Norway have exclusive jurisdiction unless mandatory consumer law in your country requires otherwise.

We may update these Terms. We will post the revised version with an updated "Last updated" date. Continued use after changes constitutes acceptance.
